If the main part of an upcoming trip to Thailand is a stay in Bangkok, customers can now cancel the contract with their tour operator free of charge. You don’t have to worry about cancellation fees, says travel lawyer Paul Degott from Hanover. On Tuesday (January 21), the Thai government declared a state of emergency in the capital over the ongoing protests. However, since this only applies to Bangkok, it is not possible to cancel a trip that mainly leads to other parts of the country. Anyone who then withdraws from the contract with the travel provider must expect fees.
When a stay in Bangkok becomes the essential part of a trip to Thailand, it cannot be precisely defined, says Degott. He assumes a share of around 50 percent. Because if the customer is to spend about half of his trip in Bangkok, the restriction due to the state of emergency is so massive that he can withdraw from the contract free of charge. What if i am stranded at the airport?
The operator or the airline has to take care of stranded customers. The services in accordance with the EU Air Passenger Rights Regulation are independent of whether the company is responsible for the delays or cancellations of flights. Passengers are entitled to food and drinks, and they usually receive vouchers for this. If the flight is postponed to another day, the airline or the organizer must take over the overnight stay in a hotel.
How do I get to my destination despite the strike?
The airline or the organizer has the duty to organize replacement transport as soon as possible. Customers can request this by phone or at the company’s counter at the airport. But vacationers shouldn’t simply buy a train ticket out of annoyance without consulting them. Because then it is questionable whether the airline will reimburse the costs, warns Degott. From the fifth hour of delay, the passenger has the right to return his flight ticket and have the costs reimbursed. With this, however, the airline is released from all obligations.
What exactly does substitute transport mean?
The airline or the tour operator must get their passengers to their destination as quickly as possible. With a shorter strike of just a few hours, Degott says, it can be enough to wait for flight operations to resume. If the standstill lasts longer, the airlines and tour operators have to take customers to other airports, for example by train or bus, and from there to the desired destination.
Am I entitled to compensation?
Under the EU Passenger Rights Regulation, travelers are now entitled to compensation in the event of a flight cancellation or massive delays. However, this does not apply if there is force majeure. According to the Federal Court of Justice, this is the case with strikes. One exception: the passenger can prove that the airline has not done everything to mitigate the consequences of the strike.
What about a package tour?
According to Degott, the legal situation is somewhat different for a package tour. The only question that arises here is whether the organizer has fulfilled its performance obligations. The reasons why it is violated does not matter. For example, if travelers are stuck at the airport for two days instead of lying on the beach, they can reduce the travel price accordingly. If it is a short trip, you can even withdraw from the trip free of charge and claim the price back. However, there is no compensation for lost vacation time.
Accommodation in a hotel complex where nudism is practiced can represent a lack of travel. This is pointed out by attorney Thomas Allgaier from the online platform ferienretter.de. In a specific case, the tour operator therefore not only had to reimburse a couple for the travel price, but also to pay compensation. What happened? The guest suing in court had booked a two-week trip to Cuba with his wife. The couple had then left the booked hotel facility prematurely and traveled back because the accommodation was in a hotel where nudism was practiced and this was tolerated by the hotel management. There was no reference to nudism in the brochures. Because of travel deficiencies, the couple has therefore requested the tour operator to partially repay the travel price in the amount of more than 5,600 euros, as well as additional claims for damages and compensation for useless vacation time in the amount of around 1,000 euros.
Naturism as a lack of travel
The Higher Regional Court (OLG) – like the regional court in the lower instance – gave the couple the right and recognized a lack of travel. Among other things, the OLG states in its reasoning: "According to this, neither the travel brochure nor the travel documents provided indicate that the guests in the holiday resort booked by the plaintiff practice nudism, the plaintiff was not otherwise advised of this. The district court also found that nudism practiced in a hotel complex is a very special form of vacation planning, which is not customary and is not to be expected when booking a hotel that has not been specially marked. The practice of nudism can definitely impair the aesthetic and shame sensations and thus the vacation enjoyment of other travelers. In any case, it is still not everyone’s taste to be in such a facility and to see strangers, naked people around you."
